Terms & Conditions

2.1 Age Requirement

The Platform is strictly for individuals aged 18 years or older. By using the Platform, you represent and warrant that you are at least 18 years of age. The Company will immediately terminate any account found to belong to a person under 18 years of age without notice or refund.

2.2 Account Accuracy

You agree to provide accurate, complete, and current information during registration and to update such information as necessary. Providing false information, including false age, identity, or medical history, is a material breach of these Terms and may result in immediate account termination.

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You must notify the Company immediately at legal@sanviau.com upon any suspected unauthorised access. The Company shall not be liable for any loss arising from your failure to secure your account.

2.4 One Account Per User

Each user may maintain only one active account. The Company reserves the right to merge, suspend, or terminate duplicate accounts without notice.

3.1 AI-Generated Reports

You expressly acknowledge and agree that:

• check_circleAll scalp and hair analyses, scores, classifications, and recommendations are AI-generated estimates based on visual image processing and are subject to inherent limitations in accuracy.
• check_circleAI analysis cannot replicate the clinical examination, tactile assessment, or professional judgment of a qualified dermatologist or trichologist.
• check_circleReports may contain errors, inaccuracies, omissions, or misclassifications due to limitations in AI technology, image quality, lighting conditions, or other factors beyond the Company's control.
• check_circleThe Company does not guarantee the accuracy, completeness, reliability, or fitness for any particular purpose of any Report.
• check_circleHair growth phase analysis (Anagen, Telogen, Catagen phase ratios) provided in Reports are estimated inferences only and cannot be clinically confirmed without trichoscopy, trichogram, or laboratory investigations.

3.2 Clinical Review

Where a Clinical Review service is offered, it is provided by independent licensed professionals engaged by the Company. Such review constitutes a professional opinion based on the AI Report and submitted images and does not create a doctor-patient relationship. The Company is not a medical provider and assumes no liability for clinical opinions rendered by third-party reviewers.

3.4 Emergency Situations

This Platform is not designed for emergency medical situations. If you are experiencing a medical emergency, you must contact your local emergency services immediately. Do not rely on this Platform for urgent or emergency medical guidance.

4.1 Free Tier

The Free Tier provides limited access to the Platform’s features as described on the Platform at the time of access. The Company reserves the right to modify, restrict, or discontinue Free Tier features at any time without notice or liability.

4.2 Paid Tier

Paid Tier access is subject to the fees, subscription periods, and features described on the Platform at the time of purchase. All fees are exclusive of applicable taxes, including Goods and Services Tax (GST) in India, which shall be charged additionally where applicable.

4.3 Payment Terms

All payments must be made in advance. The Company uses third-party payment processors and does not store payment card information. You agree to the terms of the applicable third-party payment processor. The Company reserves the right to change pricing at any time, with 30 days’ notice to existing subscribers.

4.5 Chargebacks

Initiating an unjustified chargeback or payment dispute constitutes a material breach of these Terms. The Company reserves the right to suspend or terminate your account and pursue recovery of fees plus any bank charges and legal costs incurred as a result of unjustified chargebacks.

5.1 Accurate Image Submission

You agree to submit only images of yourself or persons for whom you have obtained explicit written consent. Images must be genuine, unaltered, and of sufficient quality for analysis. Submitting manipulated, third-party, or misleading images constitutes a material breach of these Terms.

5.2 Prohibited Uses

You must not use the Platform to:

• blockImpersonate any person or entity or misrepresent your identity or affiliation.
• blockSubmit images of minors under any circumstances.
• blockUse the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• blockAttempt to reverse-engineer, decompile, disassemble, or extract the source code or algorithms of the Platform or any Report.
• blockResell, redistribute, sublicense, or commercially exploit any Report without the Company's prior written consent.
• blockUse automated bots, scrapers, or scripts to access the Platform without authorisation.
• blockInterfere with or disrupt the integrity or performance of the Platform or its infrastructure.
• blockUpload content that is defamatory, obscene, threatening, or otherwise objectionable.
• blockAttempt to access another user's account, data, or Reports.

5.3 Compliance with Laws

You are solely responsible for ensuring your use of the Platform complies with all applicable laws and regulations in your jurisdiction, including data protection laws, medical device regulations, and consumer protection legislation.

6.1 Company Ownership

All content, features, functionality, algorithms, AI models, software, Reports (to the extent they embody the Company’s proprietary technology), scoring systems, and visual designs of the Platform are owned by or licensed to Sanviau Luxe Essentials and are protected under the Indian Copyright Act, 1957, the Patents Act, 1970, the Trademarks Act, 1999, and equivalent intellectual property laws globally.

6.2 Limited Licence to User

The Company grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and your Reports for your own personal, non-commercial purposes only. This licence does not include the right to sublicense, modify, distribute, publicly display, or create derivative works from any Platform content.

6.3 User-Submitted Content

You retain ownership of images you submit. However, by submitting images to the Platform, you grant the Company a worldwide, royalty-free, non-exclusive licence to process, analyse, store, and use such images solely for the purpose of providing the Service and, in anonymised and aggregated form only, for AI model improvement and research, subject to the Privacy Policy.

6.4 Report Ownership

Reports generated by the Platform are provided to you for your personal use. Reports may not be published, shared commercially, presented as clinical diagnoses, or used as medical evidence without the Company’s prior written consent and appropriate professional verification.

THE COMPANY SHALL BEAR NO LIABILITY WHATSOEVER FOR ANY HARM, INJURY, ADVERSE REACTION, FINANCIAL LOSS, OR OTHER DAMAGE ARISING FROM YOUR RELIANCE ON ANY AI-GENERATED REPORT, RECOMMENDATION, INGREDIENT SUGGESTION, DIETARY GUIDANCE, OR CLINICAL SUMMARY PROVIDED BY THE PLATFORM WITHOUT INDEPENDENT VERIFICATION BY A QUALIFIED MEDICAL PROFESSIONAL.

8.4 Third-Party AI Providers

The Platform utilises multiple third-party AI service providers. The Company is not liable for any errors, outages, data breaches, or failures attributable to such third-party providers. Use of third-party AI services is subject to such providers’ own terms and policies.

8.5 Force Majeure

The Company shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, war, terrorism, pandemic, government action, internet or telecommunications failures, or any other force majeure event.

11.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Indian Contract Act, 1872, and the Companies Act, 2013, without regard to its conflict of law provisions.

11.2 Jurisdiction

Subject to Clause 11.3, the courts of Hyderabad, Telangana, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

11.3 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or any Report, including any question of existence, validity, or breach, shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India), as amended. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, or in the absence of agreement, appointed by the appropriate authority. The seat and venue of arbitration shall be Hyderabad, Telangana, India. The language of arbitration shall be English. The arbitral award shall be final and binding on both parties.

11.4 International Users

If you access the Platform from outside India, you do so voluntarily and are responsible for compliance with local laws. The Company makes no representation that the Platform is appropriate or available in all jurisdictions. By using the Platform, international users irrevocably submit to the governing law and jurisdiction set out in this Clause 11.

12.1 Termination by Company

The Company reserves the right to suspend or terminate your access to the Platform immediately and without notice or liability if:

• (a) you breach any provision of these Terms;
• (b) the Company is required to do so by law;
• (c) the Company reasonably suspects fraudulent, abusive, or illegal activity; or
• (d) for any other reason at the Company’s sole discretion.

12.2 Termination by User

You may terminate your account at any time by contacting legal@sanviau.com. Termination does not entitle you to a refund of any fees paid. All licences granted to you shall immediately cease upon termination.

12.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. The Company may delete your account data in accordance with the Privacy Policy. Clauses 6, 7, 8, 9, 10, 11, 13, and 14 shall survive termination.

14.1 Entire Agreement

These Terms and Conditions, together with the Privacy Policy and any other policies published on the Platform, constitute the entire agreement between you and the Company regarding your use of the Platform and supersede all prior agreements, representations, or understandings.

14.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14.3 Waiver

The Company’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Amendments

The Company reserves the right to modify these Terms at any time. Amendments will be posted on the Platform with an updated effective date. Your continued use of the Platform after such posting constitutes acceptance of the amended Terms. Where required by applicable law, the Company will provide advance notice of material changes.

14.5 Assignment

You may not assign or transfer any rights or obligations under these Terms without the Company’s prior written consent. The Company may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
